Terms of Use

These Terms of Use ("Terms") govern your use of the RoadBook application (the "App") provided by Oculapps85 ("we", "us", "our"). By using the App you agree to these Terms. If you do not agree, do not use the App.


1. Eligibility
You must be at least the age of digital consent in your country to use the App. By using the App you confirm that you meet this requirement.


2. Your account
You sign in using Sign in with Apple. You are responsible for activity that occurs under your account. Keep your device and Apple ID secure.


3. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own lawful, non-commercial purposes, subject to these Terms and the Apple Media Services Terms and Conditions.


4. User-generated content and community
The App lets you create routes and, optionally, share them with the community. You retain ownership of the content you create. By sharing content publicly, you grant other users and us a worldwide, non-exclusive license to view, download, store, and use that content within the App for the purpose of operating the community feature.

You are solely responsible for the content you share and confirm that you have the right to share it and that it does not infringe anyone's rights.


5. Acceptable use and zero tolerance for objectionable content
There is zero tolerance for objectionable content or abusive behavior. You agree not to post, share, upload, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, hateful, or otherwise objectionable, and not to impersonate others or engage in spam or abusive behavior.

To keep the community safe, the App provides:
- Filtering and moderation. Shared content is subject to community reporting and automated and manual moderation. Content that is reported may be automatically hidden and reviewed.
- Reporting. You can report objectionable content or abusive users from within the App. We aim to review reports and act on violations promptly, typically within 48 hours.
- Removal and blocking. We may remove content and block or ban users who violate these Terms. A blocked user can no longer share, like, download, or report community content, and their shared routes are removed from the community. This does not affect their private, personal use of the App.

We reserve the right, but are not obligated, to monitor, review, and remove content, and to suspend or terminate accounts that violate these Terms.


6. Navigation and safety disclaimer
The App is a planning and reference tool for recreational routes. Routes, distances, tulip diagrams, and any generated guidance may be inaccurate or incomplete. You are responsible for your own safety and for obeying all traffic laws and road signs at all times. Do not interact with the App while driving. We are not liable for any consequences of relying on route information, including navigation errors, road conditions, or map data.


7. Subscriptions and purchases
The App offers an optional Premium subscription, monthly or yearly. Payment is charged to your Apple account at confirmation of purchase. The subscription renews automatically at the same price unless it is cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your App Store account settings; deleting the App or your account does not cancel it. Introductory offers, if any, are shown at the point of purchase and apply once per Apple account. Prices and features are described at the point of purchase. Refunds are handled by Apple under its terms. Apple's standard Licensed Application End User License Agreement also applies. Premium is linked to your RoadBook account and can be restored on other devices.

**When Premium ends.** Your routes are never deleted when your subscription ends, and everything becomes available again as soon as you subscribe again. Until then, the free plan applies to your existing routes: you can use up to three routes (the ones you edited most recently when Premium ended), the other routes are locked, and tulip diagrams and roadbooks are available up to 25 km per route. On the free plan all routes are public. Routes you kept private while on Premium therefore become public in the community 14 days after the App first notifies you of this. The App reminds you each time you open it during that period, so you can delete those routes or subscribe again before they become public.


8. Account deletion
You can delete your account from within the App. Deleting your account removes your account data and community content associated with it, in accordance with our Privacy Policy. Private content stored in your own iCloud account is managed through your Apple ID.


9. Intellectual property
The App, its design, and its content (excluding your user content) are owned by Oculapps85 and protected by applicable laws. You may not copy, modify, reverse engineer, or distribute the App except as permitted by law.


10. Disclaimers and limitation of liability
The App is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for loss of data, arising from your use of the App.


11. Termination
We may suspend or terminate your access to the App or the community features if you violate these Terms.


12. Changes to these Terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.


13. Governing law
These Terms are governed by the laws of The Netherlands, without regard to conflict of law principles.
